LAKE RULES
Lake of the Pines is a private lake for use only by Homeowners. The Covenants of Lake of the Pines do not allow any one other than owners, i.e. renters or friends to swim, boat or fish in the lake.
FISHING…
§ Fishing is limited to Homeowners. Guests and family may fish when accompanied by the Homeowner. The lake is stocked with trout every other year. Your HOA dues contribute to the purchase of the trout.
§ Fishing is Catch and Release only. In the case of a fish that is injured and bleeding, please take the fish home and eat it.
§ Only artificial bait and flies with a maximum of two hooks and without barbs may be used. Do NOT use treble hooks as they cause too much damage to the fish. Children may use live trout bait.
§ Trout are very fragile and go into shock when caught. To release the fish, please hold it in the water until it swims from your hand. Trout will die if not handled properly.
BOATING
§ Small boats and canoes should be kept on the beach area on Lake Shore Drive. Please write your name on the bottom of your boat for identification. Please note that boats left during the winter may be damaged by snow and snowplowing.
§ No gasoline motors of any kind are allowed on lake.

LAKE USE and RELEASE OF LIABILITY
HOMEOWNER ASSUMPTION OF RISK, RELEASE OF LIABILITY, AND ACKNOWLEDGMENT OF RULES WHEN USING LAKE OF THE PINES
This full release is an enforceable contract between you and the Owner of the Lake of the Pines lake and the LOPPO Association. As an Owner in Lake of the Pines, you automatically agree to this release of liability and waiver of certain legal rights when you use Lake of the Pines lake and the surrounding premises.
§ In consideration of being allowed to access and use, in any way, Lake of the Pines lake and the surrounding premises (collectively the “Lake Property”, you acknowledge and agree as follows:
1. Potential Risks. Use of the lake property involves risks. It is not possible to compile a complete listing of the risks. However, they include the possibility that you may suffer serious, even fatal injury or illness. The use of alcohol or drugs may increase your risks.
2. You assume all risks. You voluntarily, knowingly and freely assume, and take full responsibility for all risks, known and unknown, related to your access to and use of the lake property.
3. You release all claims against the Lake Owner and Operator. You, for yourself and your heirs, assigns, personal representatives and next of kin, release indemnify and hold harmless the Lake Owner and Operator from any and all causes of action (including but not limited to negligence, claims, demands, losses, expenses (including attorneys’ fees and costs) and liability arising out of or related to any injury, disability, or death that you may suffer or loss of or damage to property (including theft by third parties), arising directly or indirectly from your access to or use of the Lake Property.
4. If you are a parent or legal guardian of any guest who is younger than 18 (child), you assume all risks and release all claims on behalf of child. If you are the parent or legal guardian of a child, you assume all risks and release all claims on behalf of your child and your child’s heirs, assigns, personal representatives and next of kin in the same way and to the same extend as you did for yourself in Section 2 and 3.
5. If you cause damage to the Lake Property, you agree to pay for its repair, which may include court costs and attorneys fees.
6. You agree to follow all of the rules and conditions which are included in this full release.
